Land and condominium ownership

Under the Land Code B.E. 2497 (1954), generally foreigners are not allowed to own land in Thailand. However, it is possible for a company with foreign shareholders to own land in Thailand, provided the percentage of foreign shareholding in such company does not exceed 49 percent.

A notable exception from the prohibition to own land is provide to foreigners investing over THB 40 million. They can own up to 1 Rai of land for residential purposes by obtaining permission from the Minister of Interior.

Under the Condominium Act B.E. 2522 (1979 (as amended), foreign ownership is limited to 49 percent.
